Session of all Judges

Governed by Articles 44 and 46-47 of the Law on Organization of Courts, Articles 25 and 26 of the Book of Court Rules and Articles 11-23 of the Rules of Organization and Operation of the Supreme Court of Cassation

The Session of all the Judges of the Court consists of the President and judges of the Supreme Court of Cassation.

A Session of all the Judges of the Court is chaired by the President of the Court; it is convened whenever necessary, or at the request of a court department or at least one third of all the judges. A Session of all the Judges of the Court is convened in the event of inconsistency of the opinions of panels from different departments or between the departments regarding the application of regulations, when the departmental Session of all the Judges cannot adopt a legal position, and in other cases stipulated by law and the Book of Court Rules.

The scope of work of the Session of all the Judges of the Court is:

  • Reviews the application of regulations governing the issues from the purview of the courts;
  • Reviews the application of laws and regulations;
  • Appoints the judges of the Constitutional Court;
  • Provides an opinion on a candidate for judge of the Supreme Court of Cassation;
  • Provides an opinion on a candidate for President of the Court;
  • Reviews the work of courts and judges;
  • Adopts the Rules of Organization and Operation of the Supreme Court of Cassation;
  • Decides on the initiation of the procedure for assessing the constitutionality of laws and the legality of regulations and other general acts;
  • Decides on the dismissal of the President of the Court;
  • Appoints the judge who performs the function of President of the Court;
  • Decides on the exclusion and recusal of the President of the Court;
  • Decides on the objection of a judge of the Supreme Court of Cassation to the annual work schedule, change in the type of work, deviation from the order in which the cases were assigned, and on the removal of a case from a judge;
  • Appoints the Secretary of the Court at the proposal of the President of the Court;
  • Performs other duties specified by law and the Rules of Organization and Operation of the Supreme Court of Cassation.

Valid decision-taking at the Session of all the Judges of the Court requires the participation of the majority of the total number of all the judges. Decisions are made by majority vote of the present judges of the Supreme Court of Cassation.
